1. About BartaBase

BartaBase is an online marketplace platform that enables users to buy, sell, donate, exchange, discover, and communicate regarding products, goods, and services.

BartaBase is not a retailer, reseller, distributor, warehouse, logistics provider, delivery company, broker, agent, auctioneer, insurer, or party to transactions conducted between users unless expressly stated otherwise.

Transactions are entered into directly between users, and users assume full responsibility for their dealings with one another.

2. Acceptance of Terms

By creating an account, listing an item, submitting an offer, purchasing, donating, exchanging, messaging another user, or otherwise using BartaBase, you agree to comply with these Terms of Service, Privacy Policy, Cookie Policy, Acceptable Use Policy, Community Guidelines, and any additional policies published by BartaBase.

3. Eligibility

You must be legally capable of entering into binding contracts under applicable law to use BartaBase.

By using the platform, you represent and warrant that all information provided is accurate, complete, and current.

4. User Accounts

• You are responsible for maintaining the security of your account.
• You are responsible for all activity occurring under your account.
• You must not share account credentials with third parties.
• You must provide truthful registration information.
• You must promptly update inaccurate or outdated information.

5. Marketplace Listings

Sellers are solely responsible for all listings, descriptions, photographs, pricing information, and other content they publish.

Sellers represent and warrant that:

• They own the item or have authority to sell or transfer it.
• The item description is accurate and complete.
• Images accurately represent the item.
• The item is lawful to sell, donate, or exchange.
• Material defects have been disclosed.

BartaBase does not verify listing accuracy and assumes no responsibility for errors, omissions, misrepresentations, or inaccuracies in user-generated content.

6. Purchases and Transactions

Users are responsible for conducting appropriate due diligence before completing any transaction.

Buyers should independently verify item descriptions, ownership, authenticity, condition, compatibility, legality, and suitability before proceeding with a purchase.

7. Donations and Free Items

BartaBase may facilitate donations and free-item transfers between users.

Donated items are provided strictly on an "as-is" basis by the donating party.

BartaBase makes no representations regarding the condition, quality, safety, functionality, ownership, authenticity, or suitability of donated items.

Recipients accept donated items entirely at their own risk.

8. Exchanges and Barter Transactions

Users participating in exchanges or barter arrangements assume all risks associated with such transactions.

BartaBase does not verify ownership, value, authenticity, condition, or suitability of exchanged items and is not responsible for disputes arising from exchange transactions.

9. Offers and Negotiations

Offers submitted through the platform are solely between users.

Sellers reserve the right to accept, reject, counter, or ignore offers at their sole discretion.

BartaBase does not guarantee the completion of any negotiation or transaction.

10. Pickup, Delivery and Logistics

Users are responsible for arranging and coordinating delivery, shipping, logistics, or pickup unless expressly provided through a BartaBase logistics partner.

Self Pickup Disclaimer

By selecting the Self Pickup option, you acknowledge and agree that BartaBase acts solely as a marketplace platform connecting buyers, sellers, donors, and exchange participants. BartaBase does not take possession of, inspect, verify, store, transport, package, ship, or deliver any items listed on the platform.

Users are solely responsible for arranging and completing pickup, verifying the identity of the other party, inspecting the item, confirming its condition, authenticity, suitability, ownership, and legality, and ensuring their own safety throughout the transaction process.

BartaBase makes no representations or warranties regarding the quality, condition, authenticity, ownership, legality, safety, availability, merchantability, or fitness for purpose of any listed item.

BartaBase shall not be responsible or liable for any loss, damage, injury, death, theft, fraud, misrepresentation, dispute, delay, inconvenience, or claim arising from or related to transactions conducted between users, including self-pickup transactions.

Users are strongly encouraged to meet in safe public locations, exercise caution, and take all reasonable measures to protect themselves and their property when participating in self-pickup transactions.

By proceeding with Self Pickup, you agree that all risks associated with the transaction are assumed solely by the participating users.

11. Payments

Payments processed through BartaBase or third-party payment providers are subject to the terms and conditions of those providers.

BartaBase does not guarantee payment authorization, settlement, availability, uninterrupted processing, or protection against payment disputes.

12. Refunds and Disputes

Unless expressly stated otherwise, BartaBase is not obligated to issue refunds for transactions conducted between users.

Refund requests and disputes are generally matters between the participating users unless BartaBase elects to intervene.

13. Prohibited Conduct

• Fraud or attempted fraud.
• False or misleading listings.
• Counterfeit goods.
• Sale of stolen property.
• Harassment, abuse, or threats.
• Spam activities.
• Illegal products or services.
• Circumvention of platform controls.
• Unauthorized access attempts.
• Use of bots or automated systems without permission.

14. User Generated Content

Users retain ownership of content they submit to the platform.

By posting content, users grant BartaBase a worldwide, non-exclusive, royalty-free, transferable license to host, store, reproduce, display, distribute, modify, and promote such content in connection with operating and marketing the platform.

15. Account Suspension and Termination

BartaBase may suspend, restrict, remove content from, or permanently terminate accounts at its sole discretion where necessary to protect users, the platform, its reputation, or its business interests.

Serious violations may result in immediate account termination without prior notice.

16. Marketplace Safety

Users are solely responsible for evaluating risks associated with transactions, meetings, deliveries, pickups, exchanges, and donations.

BartaBase strongly recommends meeting in safe public locations and exercising caution when interacting with other users.

17. Disclaimer of Warranties

BartaBase and all services are provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, BartaBase disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, or availability.

18. Limitation of Liability

To the maximum extent permitted by law, BartaBase, its affiliates, directors, officers, employees, agents, licensors, and partners shall not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or economic damages arising from:

• Transactions between users.
• Listings or item descriptions.
• Self-pickup arrangements.
• Delivery arrangements.
• Donations.
• Exchange transactions.
• Payment failures.
• User misconduct.
• Loss of profits, revenue, goodwill, or data.

19. Indemnification

Users agree to indemnify, defend, and hold harmless BartaBase, its affiliates, directors, officers, employees, agents, and partners from any claims, liabilities, damages, losses, penalties, judgments, costs, or expenses arising from:

• Their use of the platform.
• Violation of these Terms.
• Violation of applicable laws.
• Transactions conducted with other users.
• Content submitted to the platform.

20. Modifications

BartaBase reserves the right to modify these Terms at any time.

Continued use of the platform after modifications become effective constitutes acceptance of the revised Terms.

21. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable within the jurisdiction in which BartaBase operates.
